Terms of Service

1. Acceptance of Terms

By accessing and using BookingHub ("the Platform", "we", "our", or "us"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Platform.

2. Description of Service

BookingHub is a booking and payment platform that connects service providers ("Businesses") with customers ("Customers"). We facilitate:

  • Online booking management
  • Payment processing through Stripe
  • Business profile pages
  • Calendar and availability management
  • Customer communication tools

3. User Accounts

3.1 Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Update your information to keep it current
  • Accept responsibility for all activities under your account

3.2 Account Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent that you meet this requirement.

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these terms or for any reason at our discretion.

4. Business Subscriptions

4.1 Subscription Plans

Businesses must maintain an active subscription to use the Platform. Available plans:

  • Starter Plan: $39/month + 2% platform fee on all bookings
  • Pro Plan: $59/month + 0% platform fee
  • Founding Member Plan: $29/month + 1% platform fee (limited availability, lifetime price guarantee for continuous members)

All plans include the same core features. The primary differences are monthly subscription cost and platform fee percentages. Platform fees are calculated on the total booking amount and are separate from Stripe's payment processing fees.

4.2 Billing

Subscription fees are billed monthly in advance. Platform booking fees (where applicable) are deducted from each transaction processed through Stripe Connect.

4.3 Cancellation and Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial months or unused services.

4.4 Price Changes

We reserve the right to modify subscription prices and platform fees at any time. Changes to subscription prices will be communicated to you at least 30 days in advance and will take effect at the start of your next billing cycle. Changes to platform fees may be implemented with reasonable notice. Continued use of the Platform after price changes constitutes acceptance of the new pricing.

4.5 Failed Payments

If a subscription payment fails, your account will be suspended until payment is resolved. Continued payment failure may result in account termination.

5. Payment Processing

5.1 Stripe Connect

All payment processing is handled through Stripe. By using our Platform, you agree to be bound by Stripe's Services Agreement and Connected Account Agreement.

5.2 Business Responsibilities

Businesses are responsible for:

  • Setting accurate service prices and deposit requirements
  • Honoring bookings and providing services as described
  • Handling refunds and disputes with customers
  • Complying with all applicable laws and regulations

5.3 Customer Payments

Customers agree to pay the full amount for services booked. Deposits are non-refundable unless otherwise specified by the Business.

5.4 Platform Fees

Platform fees are calculated as a percentage of each booking transaction (Starter Plan only) and are automatically deducted from all payments (deposits and remaining balance). These fees are in addition to Stripe's standard processing fees. Platform fees are subject to change with reasonable notice, and continued use of the Platform after fee changes constitutes acceptance of the new fee structure.

6. User Conduct

You agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or viruses
  • Harass, abuse, or harm others
  • Engage in fraudulent activities
  • Attempt to circumvent payment processing
  • Scrape or data mine the Platform
  • Impersonate others or provide false information

7. Intellectual Property

The Platform, including all content, features, and functionality, is owned by BookingHub and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of content you upload but grant us a license to use, display, and distribute it as necessary to provide our services.

8. Disclaimers and Limitation of Liability

8.1 "As Is" Service

The Platform is provided "as is" without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free service.

8.2 Not a Party to Transactions

BookingHub is a platform provider only. We are not a party to the relationship between Businesses and Customers. We are not responsible for:

  • Quality of services provided by Businesses
  • Conduct of Businesses or Customers
  • Disputes between Businesses and Customers
  • Accuracy of business listings or information

8.3 Limitation of Liability

To the maximum extent permitted by law, BookingHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless BookingHub from any claims, damages, losses, liabilities, and expenses arising from your use of the Platform, violation of these terms, or violation of any rights of another party.

10. Dispute Resolution

Any disputes arising from these terms or your use of the Platform shall be resolved through binding arbitration in accordance with Australian law. You waive any right to participate in class action lawsuits.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes. Continued use of the Platform after changes constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by the laws of Australia. Any legal action must be brought in the courts of South Australia.
